Sunan at-Tirmithiy كتاب الطلاق واللعان

حَدَّثَنَا هَنَّادٌ حَدَّثَنَا وَكِيعٌ عَنْ سُفْيَانَ عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ مَوْلَى آلِ طَلْحَةَ عَنْ سَالِمٍ عَنْ أَبِيهِ أَنَّهُ طَلَّقَ امْرَأَتَهُ فِى الْحَيْضِ فَسَأَلَ عُمَرُ النَّبِىَّ صلى الله عليه وسلم فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُطَلِّقْهَا طَاهِرًا أَوْ حَامِلاً. قَالَ أَبُو عِيسَى حَدِيثُ يُونُسَ بْنِ جُبَيْرٍ عَنِ ابْنِ عُمَرَ حَدِيثٌ حَسَنٌ صَحِيحٌ وَكَذَلِكَ حَدِيثُ سَالِمٍ عَنِ ابْنِ عُمَرَوَ قَدْ رُوِىَ هَذَا الْحَدِيثُ مِنْ غَيْرِ وَجْهٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِىِّ صلى الله عليه وسلم. وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِىِّ صلى الله عليه وسلم وَغَيْرِهِمْ أَنَّ طَلاَقَ السُّنَّةِ أَنْ يُطَلِّقَهَا طَاهِرًا مِنْ غَيْرِ جِمَاعٍ. وَقَالَ بَعْضُهُمْ إِنْ طَلَّقَهَا ثَلاَثًا وَهِىَ طَاهِرٌ فَإِنَّهُ يَكُونُ لِلسُّنَّةِ أَيْضًا. وَهُوَ قَوْلُ الشَّافِعِىِّ وَأَحْمَدَ بْنِ حَنْبَلٍ. وَقَالَ بَعْضُهُمْ لاَ تَكُونُ ثَلاَثًا لِلسُّنَّةِ إِلاَّ أَنْ يُطَلِّقَهَا وَاحِدَةً وَاحِدَةً. وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِىِّ وَإِسْحَاقَ. وَقَالُوا فِى طَلاَقِ الْحَامِلِ يُطَلِّقُهَا مَتَى شَاءَ. وَهُوَ قَوْلُ الشَّافِعِىِّ وَأَحْمَدَ وَإِسْحَاقَ. وَقَالَ بَعْضُهُمْ يُطَلِّقُهَا عِنْدَ كُلِّ شَهْرٍ تَطْلِيقَةً.
Sālem's father narrated that he had divorced his wife during her menstrual period. ‘Umar asked the Prophet, peace and blessings of God be upon him, about that and he replied, "Order him to take her back, then divorce her when she is clean (from the menstrual discharge) or (otherwise) pregnant (1)." Footnotes: (1) Menstruation and the period of puerperal discharge are times when marital relationships are temporarily paused. حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا حَاتِمُ بْنُ إِسْمَاعِيلَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَرْدَكَ عَنْ عَطَاءٍ عَنِ ابْنِ مَاهَكَ عَنْ أَبِى هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ثَلاَثٌ جِدُّهُنَّ جِدٌّ وَهَزْلُهُنَّ جِدٌّ النِّكَاحُ وَالطَّلاَقُ وَالرَّجْعَةُ. قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ. وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِىِّ صلى الله عليه وسلم وَغَيْرِهِمْ. قَالَ أَبُو عِيسَى وَعَبْدُ الرَّحْمَنِ هُوَ ابْنُ حَبِيبِ بْنِ أَرْدَكَ الْمَدَنِىُّ وَابْنُ مَاهَكَ هُوَ عِنْدِى يُوسُفُ بْنُ مَاهَكَ.
The Messenger of God, peace and blessings of God be upon him, said, “Three matters to be taken seriously whether in earnest or in jest: marriage, divorce, and taking back a wife (after a divorce that is not final).”(1) Footnotes: 1- The purpose of this is to affirm the seriousness of the three issues mentioned in the ḥadīth. If all people were to treat these matters lightly and undertake them in jest, the rulings set by Allah regarding them would be nullified. Thus, it does not matter if a person says, "I was only joking," as he will be accountable for the ensuing effects of what he has uttered in this regard. In such cases, the rulings concerning marriage or divorce or taking back a wife will be valid and effective. حَدَّثَنَا مَحْمُودُ بْنُ غَيْلاَنَ أَنْبَأَنَا الْفَضْلُ بْنُ مُوسَى عَنْ سُفْيَانَ أَنْبَأَنَا مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ وَهُوَ مَوْلَى آلِ طَلْحَةَ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنِ الرُّبَيِّعِ بِنْتِ مُعَوِّذِ بْنِ عَفْرَاءَ أَنَّهَا اخْتَلَعَتْ عَلَى عَهْدِ النَّبِىِّ صلى الله عليه وسلم فَأَمَرَهَا النَّبِىُّ صلى الله عليه وسلم - أَوْ أُمِرَتْ - أَنْ تَعْتَدَّ بِحَيْضَةٍ. قَالَ وَفِى الْبَابِ عَنِ ابْنِ عَبَّاسٍ قَالَ أَبُو عِيسَى حَدِيثُ الرُّبَيِّعِ الصَّحِيحُ أَنَّهَا أُمِرَتْ أَنْ تَعْتَدَّ بِحَيْضَةٍ.
Ar-Rubayyi' Bint-Mu'awwith Ibn-'Afrā' initiated her divorce (1) during the time of the Prophet, peace and blessings of God be upon him, so he ordered her - or she was ordered (2) - to observe one menstruation as a prescribed period. (3). Footnotes: (1): (khul') Divorce at the instance of the wife, who has to give a compensation to her husband. (2): One of the narrators was uncertain whether it was the Prophet, peace and blessings of God be upon him, who ordered her or someone else. Another narration indicates that it was 'Uthmān who ordered her, and that in doing so he was merely following the judgment which the Prophet, peace and blessings of God be upon him, had given in another similar case.
